Mineralicious! Makeup Independent Consultant Agreement

Please read the following agreement. By purchasing this item, you are agreeing to be bound by the policies and terms below.

As an Independent Consultant, I understand that I am not an employee of Mineralicious! Makeup and that I am provided no guarantee of income or wages. Any income derived through my association with Mineralicious! Makeup will be based solely upon my own efforts to sell and market the product to customers.

I agree to abide by the rules and policies described herein, as well as in the Mineralicious! Makeup Independent Consultant Handbook. I understand that rules and policies may be changed at any time and that if I disagree with any of those changes, I will remove myself as a consultant within 2 business days of being notified of the changes. Said changes will be documented via the Mineralicious! Makeup Wiggio Group that I am required to be a part of.

I agree to promote and sell Mineralicious! Makeup products by personally conducting Home Parties, community events, catalog shows, internet and/or personal sales. I understand that there are no monthly sales minimum or quotas. I do understand that there is a quarterly Roll Call that I must participate in to maintain an Active status. I understand that failure to participate in a mandatory roll call by the specified time will revoke my active status and I shall be deemed Inactive.

I agree to conduct myself in a business like manner when representing the company, whether at a home show, event, on the internet, in person and/or with other consultants. Should a problem arise, I will contact the owner of the company via one of the contact methods provided in the back office or Wiggio group. Failure to respect customers, fellow consultants, Mineralicious! staff, etc is a major offense & a breach of this agreement. As such, my status as a consultant may be terminated.

I agree that I will not join, sell or recruit for another company whose main product line is mineral makeup, as this is a conflict of interest. If I am in doubt of whether or not a company meets this criteria, I will inquire with the owner of the company before signing up with that particular company. Companies who sell mineral makeup as a sideline but whose main product line is concentrated in other areas are exempt from this clause. (For example, Avon carries mineral makeup, however they have a very diverse product line that is not centered completely on minerals).

I am aware that classes, training sessions and meetings are all available for my benefit should I choose to utilize them. I understand that I am not required to attend any of these sessions.

I agree that either I myself or Mineralicious! can terminate this agreement at any time, for any reason, with written notice. I understand that if my agreement is terminated and I have an order or orders pending that have NOT shipped, I can cancel those orders for a refund. In the case that the order was paid for via credit card, there will be a processing fee charged to cover the fees associated with the charge and return. Any commissions due will be paid out on the next scheduled payout date, regardless of what day the agreement is terminated.

I agree that should I not be able to find the information I need, to first check with my upline and if he/she does not know the answer, to consult with the owner of the company via one of the contact methods listed in the back office or Wiggio group.

I agree that if at any point that I have an issue with my upline sponsor, that I should try to work it out as best as I can. If for some reason we cannot resolve the issue, I do understand that I have the option to request a transfer to a new team.

I agree to be responsible for payment of all applicable State and Federal taxes. I agree to comply with all Federal, State and local rules and regulations pertaining to Independent Consultants. I will do my due diligence to research the laws in my area if I am not familiar with them already.

I understand that if I take an order via email, home party, in person, etc; I am required to place said order via the company website within 48 hours. The only exceptions to this rule are: hostess request to change party closing date or payment for order has not yet been received (in the instance of a check or money order). Orders that have been paid via PayPal or cash should be placed within the specified time period. This is to ensure that our reputation as a company, as well as your reputation as a consultant, is not tarnished. This policy is strictly enforced, and failure to comply will result in termination of this agreement and removal of your consultant status.

I understand that I am required to join the Mineralicious! Makeup Wiggio Group for consultants. I agree to remain on the Wiggio group for as long as I remain a consultant, as this is one of the main resources of company news, policy changes, etc. I understand that should I choose Daily Digest for group mail delivery, that it is my responsibility to check for important updates so that I remain informed of changes in the company. Failure to join or remain a member of the Wiggio group is a breech of this agreement and I understand that I may have my agreement and status as a consultant terminated unless extenuating circumstances occur.

I understand that making false statements, misrepresenting the company or otherwise engaging in libelous or slanderous remarks against the company or owner will result in immediate termination of this agreement and may result in legal action.

This agreement shall be governed by the laws of the State of Missouri and shall become binding once approved and signed by the owner of Mineralicious! Makeup. I agree that any legal action regarding this agreement must be brought exclusively in St Louis County, Missouri.

By digitally or physically signing and returning this form, I am hereby applying to be an Independent Consultant with Mineralicious! Makeup. I attest that the information given is complete and true. I agree to the terms and conditions found on this form. I am at least 18 years of age, a legal U.S. citizen or resident and am legally able to enter into this agreement. I understand that by purchasing this item, I am as bound by these terms and conditions as I would be if I signed a paper agreement. I understand that violation of any company policy can result in immediate termination of this agreement and removal of my status as a consultant with the company.
